Yes, that fear is definitely an issue with the Cog Railway (one of two big issues - parking is the other one). And I should have said that I'm very surprised there haven't been any lawsuits (that I know of), since we're such a sue-happy culture.
I tried to sue once but settled out of court for a lifetime supply of summit donuts.

There have been some pretty heinous injuries up there, but as far as I know there haven't been any lawsuits.

It wasn't clear to me how much/if her chief complaint was them being out there or not, based on the (poor) wording of the article.
As to their actions, picturing it being said to my wife, I'd think....well...this =)
